
What is Despite Resolution?
Often when you have a dispute with another party whether as an individual or as part of an organisation or company, your first thought may be to take the other party to court in order to achieve a result. However, entering into court proceedings and litigation can be very expensive and costly for all parties involved. You have solicitors fees, barristers fees, and court costs to factor in and then the time it could take whilst in court can become an exhausting process.
1. Independent Negotiations
This involves both parties negotiating the terms of a settlement agreement without the courts involved in order to agree and settle a dispute in a more cost-effective manner. Typically each party would instruct their own representative to act on their behalf. 2. Mediation
Mediation is one of the most regularly used methods of ADR. In mediation, an independent and neutral advisor works with all parties to allow them to reach a mutually acceptable agreement or solution without taking the matter to court.
3. Arbitration
This method involves appointing either a neutral third-party arbitrator, or panel of arbitrators, who are experts in the field where the dispute arises. They are instructed to hear evidence and make a legally binding decision on behalf of the parties.
4. Conciliation
This method is generally used for employment disputes and is a compulsory process before an employee can bring a claim to the Employment Tribunal. The conciliator will discuss the issues with both parties to reach an agreement, but their opinion is not legally binding.
That is why dispute resolution is better and more cost effective method of finding amicable resolutions for such complex disputes. ADR has different forms of resolutions and it would depend on the nature of the dispute as to what the best course of action would be for your individual circumstance.
